Hart"s legal philosophy rejects the idea that a jurisprudential inquiry into the law is merely an attempt to find a definition of law. Rather, he is concerned with analysing the nature of law in an effort to advance a legal theory through an advanced analysis of the distinctive structures of a public legal system". In doing so he identifies three main common issues of legal jurisprudence: How to differentiate the obligatory force of law from the conduct that calls for coercive force. How to separate legal obligations from moral obligations. How to distinguish legal rules, or more broadly social rules requiring certain behaviour, from rules which merely describe a behavioural pattern of people without determining that they are required to act in such a way. Here we shall examine the second point of hart"s legal philosophy; that of the place of morality in legal systems.
