JOUR 625 Lecture Notes - Lecture 7: Revenge Porn, Sexual Misconduct
Document Summary
The public"s revenge- cracking down on revenge pornography websites. Adults and kids are more than likely using their phones to take, share, or get sexually explicit messages and pictures. Victims have tried to get civil litigation because of invasions to privacy, but this has been more unsuccessful in courts. Often defendants plead guilty to these crimes and get sentenced under fraud, identity theft or other unrelated laws to the photos they posted. There are concerns with the sentences associated with the crimes that have been committed. If school districts or employees try to restrict personal communication with their employees or adults, there are more problems that could come. Courts will probably think policies made to stop communication are unconditional, even if it deals with teachers dealing with minors. Policies dealing with texting and social media are more likely to uphold judicial scrutiny. Policies dealing with restricting communication for adults will face more scrutiny as well.
