Part of the debate in the rati cation of the constitution. What branches of government does it apply to federal government. 1st amendment: freedom of speech, press, religion, assembly, petition. 3rd: no soldier may be quartered in a house w/o the owners permission. 5th: no one may be forced to testify against themselves (taking the 5th); no one may be deprived of live, liberty, or property. 6th: certain rights are guaranteed in criminal trials. 9th: these rights do not diminish other rights. 10th: any powers not given to the federal gov are reserved for the states and the people. Originalism: reliance on the original meaning of the words of those who wrote the constitution. Pragmatism: the legal interpretation of the constitution evolves and must be interpreted in the context of contemporary realities.
