The obligation of the seller is performed by putting the goods in the hands of a qualified shipper and deliver them to dock. Buyer now has title and risk of loss. Seller performs the contract at the seller"s loading dock. Put the goods in the hands of a qualified shipper. Give buyer notice that the goods are en route. If the failure to give notice causes damage to the goods, then it is a material breach. If the failure to give notice does not cause damage to the goods, then it is not a material breach. Once trucking company has closed the door, title and risk of loss passes to buyer. Law presumes seller will give buyer negotiable document of title if not otherwise stated. States that seller is the owner and warehouse is the bailee. Seller gives warehouse receipt to the order of/bearer to buyer. Title and risk of loss pass when buyer receives dot.
