If i give you a sample, that is an express warranty. Gives them right to say seller hasn"t performed. If seller and buyer enter into k and they do not say. If parties do not specify otherwise, it is a shipments contract. Buy goods and sell them but they end up having defect. Would have rejected load if was discovered at loading dock. When i discover nonconformity/defect, gives you the right to revoke acceptance. Title and risk of loss reverts back to seller. When does the agent"s conduct make the principle liable to the third party.
