How you fight is independent of whether it is just or not. Moral equality of combatants (mec) comes out of the separation thesis. As long as you fight the war well (independent from jus ad bellum), you are moral. Government makes the decision not to go to war, not the combatants. Gives incentives for soldiers to act justly in war. Some individualists (such as mcmahan) believe that there is no separation. They say that it matters if you are fighting a just war or not. You can"t fight justly if you are fighting an unjust war. If you fighting on the unjust side, you are not morally equal to those fighting on the just side. We don"t have rules in any other criminal activity. If you are going to rape someone, you have to use a condom. Jus in bello - international humanitarian law.
