Matthews v. eldridge (1976) was a woman who had a disabled child and she was receiving money from social security this followed up on goldberg v. kelley. Woman was told her benefits had ended but she would have a hearing where she could argue with the decision. The argument was she should have her hearing before they cut her benefits. The supreme court agreed and now they ruled that termination of benefits are a form of property. Rights were suddenly being extended to new property . Property should be things liek social security right to attend your job right to welfare, this is a form of property and before you take away the property you have to have due process. The court said there has to be a hearing which means assembling hearing officers and hiring lawyers for both side. Turning point the court held that the initial termination of eldridge"s benefits without a hearing did not violate due process.
