Then you are in custody: interrogation: questioning on the incident. When an individual is not free to leave and the law enforcement is going to question them about the incident, then they must read them their miranda. Miranda v arizona decided upon by the supreme court of the united states. Consequences of not being read the miranda rights: at a trial of the declarant, the prosecutor may not use any statement made, in violation of the rule, on her direct case (case- in-chief). At trial, puts in witness and exhibits then prosecution rests. After the defense puts on their case (witness and exhibits and then rests) the prosecution can rebuttal. (prosecutor"s rebuttal case)
