Amount of transcription and translation can be varied. Gene expression can be regulated at many steps along the way from dna to rna to protein. Every step in multiple ways can be regulated. Rna polymerase cannot start without basal transcription factors. Base machinery needed for this to happen. Don"t decide under what conditions are expressed or not: depends on signals sent.
