Federal, states, and local agencies have different responsibilities. Offenders convicted of interstate commerce, mail fraud, bank robbery, violations of federal laws, crimes committed on federal property. Thus, counties send people to prison, but the state pays for them. Police are mostly local and corrections are mostly state. Probation less serious, court sets aside prison sentence on the condition the offender abide by certain conditions. Jail for misdemeanors, sentenced to less than 1 year, and those awaiting trial** not after realignment. Prison for felons sentenced to 1 year plus** not after realignment, only serious violent folks are going to prison. Felonies are offenses punishable by a year or more in state prison. They include the fbi index crimes (robbery, rape, burglary, assault, homicide, larceny, auto theft) Misdemeanors are less serious crimes punishable by jail only. States differ on what they define as felonies. Drug laws, child and spouse assault have been changed to felonies in recent years.
