Lecture 9 health policy & the law. Outline: objectives, what is the law & why do we need it, brief history of canada"s legal system, judicial structure. Structure of the court system: public vs private law, statutes & regulations, alternative approaches to law, the constitution, the charter, aboriginal rights, the courts & health policy. Objectives: be able to explain the principles of canada"s legal system and where they came from, understand the different levels of courts in canada. Charter challenges: understand who and what the charter protects, be able to list and describe pros and cons of the courts as policy-makers. Most common definition we can: a system of rules created and enforced through social or governmental institutes to regulate behavior (luban) Not only do we create rules, but we enforce them so enforcement is a big part of it. If you don"t have enforcement, you might as well not have any rules.
