Secion 10: everyone has the right upon arrest/detenion: (a) to be informed promptly of the reasons therefore, (b) to retain/ instruct counsel w/o delay/to be informed of that right. Secion 24(2): evidence shall be excluded if it is established that, having regard to all the circumstances, the admission of it in the proceedings would bring the administraion of jusice into disrepute . When actus reus and mens rea elements coincide, a crime has been commited. Actus reus and causaion: where the actus reus, prohibits a consequence or a result, court must determine if the accused"s acions have actually caused the prohibited consequence or result . Mens rea: concerned with the consequences of the prohibited actus reus.
