Cjs - state, huge power in how in treats people and communities (important to understand context and investigate consequences of state intervention) Central idea = idea of discretion - individual agency and individual choices. Instrumental / practical: to respond to crime to secure the benefits to the wider society such as crime prevention and reduction. Symbolic: to redress imbalances caused by those who take illegal advantage of another or diminish their human dignity (daly, 2011) Need to decide if a value/interest is so important to warrant the protection of the law (who decides this is important) Institutions of crime control: crime prevention e. g. schools, urban planners, crime and corruption commissions, detection and investigation e. g. neighbourhood watch, asic, royal commissions. Legal services e. g. community legal centres, private law firms, legal aid, bail justices: trial and adjudication e. g. community mediation centres, courts, offices of public prosecution, ombudsmen, juvenile conferences.
