Torts = a civil wrongdoing to a person, property- can be real, or personal ( property ex: Real in law means property attached to land, such as a building or house. Personal property = tangible things that move, ex: laptop. If it"s not a crime under the law, it"s called a tort. There are intentional torts (chapter 7) and the tort of negligence=carelessness. In civil actions plaintiff initiates the action/lawsuit, and sues defendant in civil court. Main purpose of plaintiff suing defendant is to get money. The purpose of a civil tort action (lawsuit) is to get money/damages, the purpose is not to punish (criminal court, a main purpose is to punish) The main differentiation between common law and statutory law is the way in which the laws are created. common law comes from precedent (and is passed by judges) It is designed to keep citizens safe as well as ensure that citizens are able to function in everyday life.
