She was used to examining living children who were suspected to have sexual abuse: mr. johnson was arrested on june 27th 1993 for first degree murder + aggravated sexual assault for his niece. He testified that evidence (bruises on chest, neck and head) indicated that she had been. Jury hear expert testimony from dr. charles smith sexually abused + suffocated. Smith said that the child had been recently sexually abused, anally penetrated. Sept 21, 1994 he was convicted of first degree murder. There was no direct physical evidence connecting him to the death** No dna evidence of him on the child. Nothing that connected him to the physical murder. But there was very strong circumstantial evidence: appeal. Dec 19, 1996 - ontario court of appeal - dismissed (his appeal) When goes to appeal, there is a panel of judges. Was pointing out lack of the forensic evidence --> no dna evidence from him on her.
