Bill of rights: designed to limit the capacity of the govt to impose conformity costs on those individuals and minorities whose views differ from those of the majority. Incorporation - using the 14th amendment to impose the bill of rights onto state govts. Barron v. baltimore (1833) - barron sues saying that the city damaged his warf because they dumped garbage in the water, there was no way at the time that he could sue the state. 5th amendment- nor shall private property be taken for public use, without just compensation. Barron says baltimore owes me compensation from 5th amendment. But bill of rights only protects against fed crimes not state crimes and baltimore, maryland is city/state. Dual citizenship - a person is both a citizen of the state and the country and these are separate affiliation. Rights are incorporated via the due process and equal protections clauses of the 14th amendment.
