What is an acceptance: court looks for the same present intent to contract on the part of the offeree , may indicate assent expressly or implied, objectively determined ! A promise is exchanged for an act ! Offeree must perform the requested act or make the requested promise ! Example: ill give you (the promise) if you nd my lost dog (the act) : she must nd the dog to accept the offer , bilateral contract ! Offeree must expressly accept the offer or impliedly accept by doing something that objectively indicates agreement : silence ! Example: see a landscaper cutting your lawn : if you dont say anything to him, thats an indication of agreement , only original offeree can accept offer , writing may/may not be important ! Apply objective test what would a reasonable person do ! Communication of acceptance: manner of communication ! Offeror may specify the time, place, or method of communicating acceptance !
