Punitive damages: used to punish the defendant and deter the defendant and others from repeating behavior that is particularly offensive (emotional distress, privacy): preponderance of evidence (a standard of proof)! When both sides have presented their evidence, the greater weight of the believable evidence must be on the plaintiffs side (victim) : applied in all civil cases, in which only money is at stake, intentional torts ! Types of behavior that indicate either the wrongdoers conscious desire to harm or the wrongdoers knowledge that such harm was substantially certain to result : negligence! Duty and we breached that duty and someone suffers harm : strict liability ! An intentional, un-consented-to touching that is harmful or offensive! Right to be free from unwanted physical contact that would offend ordinary sensibility !
