The litigation process has 3 phases: pretrial, trial, and posttrial. The pleadings: they inform each party of the other"s claims: the plaintiff"s complaint- the statement of the cause of action and the parties involved. The defendant is notified of the suit through service of process- when the plaintiff delivers/serves a copy of the complaint and a summons to the defendant. The defendant must file an answer to the complaint within a specified time period or suffer a default judgment against him (this mean"s the plaintiff is awarded all of the damages in her complaint) Any allegations not denied are deemed as admitted. Affirmative defense: the defendant admits that the complaint is true but raises new facts as to why he shouldn"t be held liable (ie self defense) Counterclaim: defendant denies the plaintiff"s allegation and sets forth his own claim- now the previous plaintiff has to submit an answer to the new counterclaim.
