Facts: plaintiff yolette ferdinand went to her neighborhood supervalu food store to purchase plantains. When entering the store, ferdinand picked up the box top (store"s version of a basket) and proceeded to the produce section, where she thought she grabbed twelve plantains. Upon check-out, the cashier only counted eleven, but allowed ferdinand to pay for twelve. She then proceeded back to the produce section and picked up one plantain, where she resumed her exit out of the store. The security guard on duty as well as defendant of this legal matter, william. Hanton, saw ferdinand take the plantain and proceed to the exit without paying for it at a register. Before she left the store, hanton asked if she had paid for the plantain or not. Ferdinand claims in court that she had paid for the twelfth plantain, but refused to tell hanton this during the incident .
