Federalism: at least two separate governments sharing responsibilities for governing the same people and territory, people wanted to spread out powers so there wasn"t too strong a central government, not all federal systems are alike, however. Some lean more towards state power and some more toward national government power: think of federalism as continuum, confederal-states have most power, unitary-federal government has all the power (france and japan) Barron vs. baltimore (1833) bill of rights protects individuals from bad actions of the national government not the state governments. These include criminal codes, health and safety codes, marriage and divorce laws, the power to define private property, etc. Civil liberties and civil rights: civil liberties-freedoms guaranteed to the individual-they take they form of negative restraints on the government. Examples-freedom of speech, press, assembly, religion, etc: civil rights-declare what government must do/provide-generally a claim upon state action, usually asserted by a group, usually the have nots in society.
