CJE-3110 Chapter Notes - Chapter 9: Call Field, Fornication, Prosector
Document Summary
Why do we refer to arrest powers as being monumental: very simply, being arrested carries a negaive image that taints the arrestee for years to come. One common myth surrounding police work is the belief in full enforcement. Broad statutes: someimes criminal statutes are writen in very broad and sweeping terms to prevent any possible loopholes, overzealous legislaive atempts to forbid gambling would fall in this area. Moral standards: another reason lafave ofers is that some statues express a moral, rather than criminal standard, some jurisdicions prohibit fornicaion, adultery, and cohabitaion, whether the police should regulate such behaviors is debatable. Outdated laws: many statutes that appear on the books are outdated relics from the past, someimes we call these prohibiions blue laws, such laws have long outlived their intended purpose. Police discreion involves the element of decision making. When handling a call in the ield, oicers must choose from a variety of alternaive acions in order to resolve the situaion.
