To them, socialist law was never alive; socialism and law contradict each other: all law cemented the power of ruling class and oppressed all others. Marx predicted that getting rid of private property would spring cooperative wealth. Russia tried to change quickly and was thrown into economic failure, civil war, and famine. Lenin passed the new economic policy of 1922, invited private property and entrepreneurship back. Law was still seen as bourgeois, and with the first five-year plan the nep stopped being used. 1936: official rehabilitation of socialist ideology in state and law: economic law was dropped from university curriculum, nep codes were revived for judicial decision making, restored property, contracts, torts, and formal court procedures. Begi(cid:374)(cid:374)i(cid:374)g of stali(cid:374)"s rule: great purge: wanted law to stabilize and discipline the country. Historical phenomenon: orthodox historians: ruthless use of terror, revisionist/social historians: ordinary life still continued, despite totalitarianism.
