The police conduct an investigation of the crime and then propose to charge the suspect with one or more offences. They could also find insufficient evidence to pursue a successful prosecution, finally they may find that evidence exonerates a suspect. Upcharge: means charging a suspect with a more serious crime. Overcharging: can also involve adding a series of charges to the offense with which the accused is being charged in to ensure that a conviction will be possible on at least some of the charges. Initial hearing: this is an opportunity for the charges that are being laid to be read to the accused. In case of a summary conviction, plea from the accused may be taken. A trial date can be set when a plea of not guilty is registered. Preliminary hearing may be set for more charges. Accused is required to select the manner of trial.
