A person"s employment is an essential component of his/her sense of identity, self worth and emotional well being. Protective legislation an attempt to infuse law into a relation of command and subordination. Main objective of labour law is to be a countervailing force to counteract the inequality of bargaining power which is inherent and must be inherent in the employment relationship. There is no universal test to determine whether a person is an employee or an independent contractor. Central question is whether the person who has been engaged to perform the service is performing them as a person in business on his own account. Burden of proof that the person is not an employee lies upon the employer or alleged employer.
