Francis was a widower and in march 1882 was married to breese. Before marriage he entered an ante-nuptial contract where it was agreed that she should be supported by the farm during her life. Elmer (16 years old) murdered francis with poison in order to get the property. Defendants: francis is dead and thus his will must be carried out. True that statutes regulating wills give the property to the murderer. Purpose of statutes: carry into effect final wishes legally expressed. It was intention of law makers that donees in will should have the property given to them. However, never intended to have the murdered benefit from it. If such case would have been present to law makers, they would have provided something in case.
