A number of observers have pointed out that the police already have significant powers to combat terrorism. The federal privacy commissioner and his provincial counterparts cautioned that additional legislation was not required and that the police and national security agencies had sufficient powers to combat the threat of terrorism. This may be particularly problematic for persons newly arrived in canada, but it may also be the case for many canadian citizens, including the elderly or persons with a mental health disability. All relevant information gathered during a case investigation must be disclosed to the defence attorney. In addition, severe restrictions have been placed on the investigative strategy of placing an undercover officer in a jail cell to elicit evidence from a criminal suspect. The scc has ruled that law enforcement and security agencies must secure a warrant prior to accessing information on persons through telecom providers.
