Document Summary

A primary function of law is the orderly resolution of disputes. The purpose of this chapter is to examine the questions of why, how, and under what circumstances laws are used in disagreements between individuals, between individuals and organizations, and between organizations. The function of law is defined in different terms from sociologists, anthropologists, and other analysts of law and its functions. Conflict regulation, conflict management, dispute processing, dispute settlement, and dispute resolution, are the definitions that are used for the function of law. There are three stages of the disputing process: grievance (preconflict): a stage when one party (individual of group) perceives something to be unjust toward them and think that have grounds for complaint. It"s monadic, meaning that it involves only one party: conflict: a stage where the offended party and the offending party confront each other. It"s dyadic, meaning that it involves two parties: dispute: a stage where conflict is made public.
