Negligence is the most important tort and you must understand its basic operation: how it arises and how you prove negligence and defend against it. We will not be requiring you to learn definitions word for word but you must understand and learn the general concepts of foreseeability, etcetera. As with all torts, if you do not know the basic definition of the specific tort, you will not have any idea of how someone could be responsible for it or defend against a claim. You will not be able to ensure measures are in place in your business to minimize the likelihood of a claim in negligence being made against the business and its employees. Students often find it difficult knowing what to focus on and we certainly do not expect a law school type understanding. For this reason, use the following as your guide:
