The term juvenile is often interpreted to refer to children younger than 18 years. U. s common law does not consider children younger than 7 years capable of mens rea. Not believed to be able to commit an intended act. Less than 10% or 2821 of those arrested for murder and nonnegligent manslaughter for the years 2002 to 2004 were younger than 18 years. Over 10 times as many children between the ages of 10 and 12 were arrested and even more or 289 between the ages of 13 and 14 were believed to have killed in these years. The bureau of justice statistics reports that among preadolescents (under the age of 14) homicide commission began increasing in the late 1980s and continued to increase in the early 1990s. Among those ages 14 to 17 there was a very rapid increase after 1985 when the rate was 10. 5 per 100 000.
