By 1973, morgentaler was already facing 3 criminal charges of illegal abortions. Roe v. wade made him optimistic about prospects for a similar change in canada. Over next 3 years, crown tried him 3 times but each time the jury acquitted him. Notwithstanding judgement of his peers, he went to prison for 10 months because quebec court of appeal overturned his 1st jury acquittal and substituted the verdict of guilty. 1981 - borowski won 3 year legal battle to obtain right (standing) to challenge. This landmark decisions significantly increased ig access to court. Later, based on his medical evidence, borowski argued that canada"s abortion law violated right to life of the unborn and should be declared invalid. The trials became symbols of the new challenged posed by charter: parliamentary supremacy vs. Prior to 1969, criminal code deemed abortion illegal except to save the life of the mother.
