In canada the jurisdictional responsibility is of each province and territory. They are regulations and policies and guidelines of education but they are not laws. In the us the federal office of education implements federally mandated laws. Ground breaking legislation in 1975 with signing of public law 94-142. Another law pl 94-457: infants 0-3, and preschoolers 3-6. In 1990 pl 94-142 introduced individuals with disabilities act (idea) Added traumatic brain injury and autism to the collection of identifiable categories. Designed to improve the academic success of all students but especially those with special needs. Mandates teachers to be fully qualified, non english students get help, drug free and safe schools. School may be subject to remedial action if students with exceptionalities fail to progress. Major criticism that the act did not exempt exceptional students from district wide or state wide yearly achievement tests. This may have undermine their access to programming based on their ieps.
