The word rape was used in the canadian criminal code until 1983, when it was then changed to sexual assault . The word rape is still used in the american legal system. There are 3 levels of sexual assault in canada: level 1 any form of sexual activity forced on another person, or non-consensual bodily contact for a sexual purpose (kissing, touching, oral sex, vaginal or anal intercourse). Involves minor injury if any to the victim. Punishable by up o 14 years in prison: level 3 sexual assault that wounds, maims, or disfigures victim(s), or endangers victim"s life. There"s no statute limitations for prosecution of sexual assault meaning a victim can go to police at any time after assault and charges can still be laid. Person has to be capable to give consent. Someone who is drunk, under the influence of drugs, unconscious, fearful, or under age is unable to give consent. The canadian law regarding sexual assault is gender-neutral.
