*note: chapters 1-3 from the cjc will be tested on the first midterm* Judges are guided by the principle of proportionality when imposing a sentence. They attempt to enture that the severity of the sentence imposed reflects the seriousness of the crime committed. A parole board is concerned whether that offender will benefit from release on parole and whether that person represents a risk to the community. Supreme court often hears arguments regarding the constitutionality of specific pieces of criminal justice legislation and decides whether a particular law is consistent with the rights guaranteed by the charter. Research has shown that making prison life more unpleasant does not result in low reoffending rates. Due process model limits the powers of the criminal justice system to prosecute accused persons. If the state is not subject to some limits, society will become intolerable, as people will be subjected to constant surveillance.
