Tort of conspiracy usually occurs when 2 or more defendant agree to act together with the primary purpose of causing the plaintiff to suffer a financial loss. It is hard to prove: ex. on pg 102. If the defendants" actions were lawful, then conspiracy is difficult to establish cuz the court will require proof that the defendants" primary purpose was to hurt the plaintiff. Situation is different if defendants conspired to perform an unlawful act then the court will only require proof that the defendants should have known that their actions might hurt the plaintiff. Tort of intimidation occurs when the plaintiff suffers a loss as a result of the defendant"s threat to commit an unlawful act against either the plaintiff or a third party: it is concerned with unethical business practices. It has 2 branches (shown in fig 5. 1 on pg 103: 2-party intimidation. It occurs when the defendant directly forces the plaintiff into suffering a loss.
