LAW 122 Chapter 7: chapter 7 notes
Document Summary
If an offer is not accepted, it may cease to exist in a variety of ways: revocation, lapse of time, death or insanity, rejection, counter-offer. Lapse of time: offeror is entitled to limit the lifespan of an offer, even if no time limit is stated, an offer is open only for a reasonable period . Death or insanity: offer is automatically revoked if either the offeror or the offeree dies, an exception may apply if the contract does not require the affected party to perform personally. Rejection: occurs when the offeree refuses an offer. Battle of the forms: occurs when each party claims to have entered into a contract on the basis of its own standard form document. If lines of communication breakdown, it is necessary to decide whether a contract was formed. If lines of communication work, it may be necessary to determine where and when a contract was formed.
