LAW 122 Chapter Notes - Chapter 5: Damages, Qualified Privilege, Punitive Damages
Document Summary
Conspiracy occurs when two or more defendants agree to act together to cause the plaintiff to suffer a financial loss. Two types of conspiracy: lawful act conspiracy, unlawful act conspiracy. Intimidation occurs when plaintiff suffers a loss as a result of the defendant"s threat to commit an unlawful act against either the plaintiff or a third party. Two branches of intimidation: two-party intimidation when defendant directly coerces the plaintiff into suffering a loss, three-party intimidation when defendant coerces a third party into acting in a way that hurts the plaintiff. Intention does not require proof that defendant intended to hurt plaintiff, therefore if other two satisfy, court can impose liability. Interference with contractual relations when defendant disrupts a contract that exists between the plaintiff and a third party. Knowledge defendant must know about the contract that exists between the third party and plaintiff.
