EMPR 240 Chapter Notes - Chapter 1: Collective Bargaining, Occupational Safety And Health, Feedback
Document Summary
Empr 240 - labour policy, january 11, 2017. Three legal regimes comprise main subject matter: common law of employment, regulatory standards, collective bargaining. When legal rules in employment contracts and government regulations conflict with other powerful economic, legal, political, social, and environmental forces present in society, sometimes it is the legal rules that are cast aside. Efficient breach: a deliberate violation of a contract or government statute owing to the belief that it is more economically efficient to violate the legal rule than to comply with it. Subsystem: a self-contained system within the broader social system that possesses its own rules, norms, and modes of communication. Examples include economic and market; legal; political; social, cultural, and religious; and eco- logical/environmental subsystems. Employers and individual employees: rule making process. When disputes arise about contracts, they are sometimes resolved through civil litigation.
