CRJS 1003 Chapter Notes - Chapter 1: Social Class, Institutionalized Discrimination
Document Summary
Justice is connected to fairness since we want our laws to be written, administered and enforced in a fair manner. People want the fairest rules possible so that no one person or group will be protected by any type of advantage. Fairness is also viewed as the balance between the states interest in apprehending criminal suspects and the publics interest in avoiding unnecessary government interference in the lies and activities of individuals. It is most closely related to what is called the justice model. This approach emphasizes that justice is achieved when the various agencies of our criminal justice system follow legal rules and procedures that are publicly know, fair, and just. Key components of this approach are ideas such as: presumption of innocence, procedural fairness, the need to follow legal rules. Discretion and unequal treatment must be reduced as much as possible.
