Individual liberty in swiss cantons is not guaranteed: the courts don"t have an independent position. In all cantons, trial by jury is unknown. In many cantons, people were without political rights. Swiss cantons, it wouldn"t be certain that people would not grow accustomed to loss of liberty. In us/england, there is more liberty in customs then in laws of people. In switzerland, there is more liberty in laws than the customs of country: de tocqueville puts together the habit of self- government, love of order, and respect for justice and a legal turn of mind. English constitution since it may not seem to be not so much the property of one nation as a trait common to every orderly state.
