It is a conduct (or an act of omission) which, when it results in certain consequences, may lead to prosecution and punishment in a criminal court. Crime is an intentional act in violation of the criminal law, committed without defence or excuse, and penalized by the state as a felony. Over criminalisation is the imposition of an excessive punishment/penalty with no relation to the gravity of the offence committed (no justification) This also includes the frequency to which that punishment is being dished out e. g. a population which is often over criminalised is aboriginals and torres strait islanders in comparison to white australians. Under criminalisation is when the punishment/penalty is too lenient without justification e. g. catholic priest being kept safe at the vatican by the pope even though he was found guilty of sexual assault crimes against children. The term crime has no reality beyond the application of the term to particular acts.
