Brown v. mississippi, 1936: death of raymond stewart occurred on march 30, 1934. Suspect indicted on april 4, 1934 and counsel was appointed to represent them. The marks of the rope used to hang him were visible during the trial. Ellington was arrested he was again severely whipped. He was told he would continue to be whipped until he confessed which he did. The other two defendants were similarly whipped until they confessed in the exact detail requested by the deputies. Due process required: due process is required both during and before a trial. Prior to brown, the emphasis on confessions was that they must be accurate. The voluntary requirement blended into the due process requirement of a fair trial after brown. Procedural error: the attor(cid:374)ey(cid:859)s in brown failed to ask for the confessions to be excluded after the coercion was proven.
