Document Summary

It must be confessed at the beginning that there is a great deal in the law of defamation that makes no sense. it is the essential conflict between right to reputation and the first. Amendment right to free expression and the media"s right to publish newsworthy stories. Libel is now considered to be an expression which injures a person"s reputation or standing in the community; however, it used to be that the statement would create ill will or hatred in the community. Libel cases in the beginning of law started out as criminal, but today most libel cases are civil. The early settlers and colonists brought this law over from england, literally. If you are charged in a criminal case, you get jail, in a civil case you have to pay money. Most libel cases do not reach the trial stage, because they settle. The benefits of this are that settling makes less news, costs less money.
