The supreme courts unanimous decision held this prohibition unconstitutional, overturning peace vs. alabama ending all race based restriction on marriage in the us. The unanimous ruling dismissed the commonwealth of virginia"s argument that law preventing interracial marriage and providing both parties with equal and identical punishment could not be constructed as racially discriminatory. The supreme court ruled that virginias anti-miscegenation statue violated both the due process and equal protection clause in the 14th amendment. Due process, states cannot makes laws which limit the privileges of its citizens. Courts noticed it was southern states that wanted this segregation, same states that argued against peoples basic human rights.
