The landlord and tenant relationship is a contractual relationship that gives rise to two concurrent interests in land: exclusive possession of the property by the tenant, and a reversion in the landlord. A leasehold is an interest in land for a term, and at the end of the term, possession reverts to the landlord. During the term of the lease the tenant is entitled to exclusive possession, however, and may then exercise many of the rights that are normally possessed by a landowner. Because it is contractual in nature, a lease may contain express terms that delineate the relationship and the rights and duties of the parties; where the lease is silent, however, some terms may be implied by law. The most common terms or covenants are the covenants to pay rent, repair, pay taxes, have quiet enjoyment, and assign or sublet as desired.
