Most criminal cases are settled out of court. Lower courts settle differences outside of the courtroom: lower courts hear about minor claims and try minor offences, upper courts hear claims with a high amount of controversy and my try all types of offences. 2 models of justice, crime control & new justice: informal plea bargains in the hallway.
