Document Summary

An aspect of state sovereignty includes both the power to prescribe rules [prescriptive jurisdiction] and the power to enforce them [enforcement jurisdiction]. Prescriptive jurisdiction (the legislative power of a state) & enforcement jurisdiction (executive & judicial power of enforcement) The power of a state to apply its national law to any person, property, territory or event, wherever they may be situated or wherever they may occur. Example: the broadcasting act 1990 of the uk, which makes it an offence to broadcast from the high seas in a manner which interferes with domestic broadcasting services. In il, there is no general prohibition against states extending their legislative jurisdiction to persons, property and events taking place outside their territory. This right to legislate flows from the absolute sovereignty of the state. The practical effect of this jurisdiction is restricted by the enforcement jurisdiction .
