National government has enumerated powers- it can undertake actions necessary to carry out its expressly designated powers. State government has police powers- can regulate private activities to help the public. No branch can exercise the authority of the other branches. 3 branches of gov- legislative (makes laws); executive (enforces laws); judicial (interprets) Senate: congress determines the jurisdiction of the federal courts, president appoints federal judges, but judicial can determine if either congress or the president is unconstitutional. Weed- the government can federally prosecute you even if the state allows it. Can regulate both interstate and intrastate if intrastate substantially affected other states. National government has the power to regulate interstate commerce- huge impact on businesses. Basically the government was able to expand its powers through this.
