Defenses: (for the employer: merit pay wages set based on performance, seniority pay been there longer, get more moneys, pay based on quantity/quality of production, legitimate factor other than gender. Title vii of the civil rights act of 1964. Originally only applied to govt. workers, however no application to private employers w/ employees > 15. Cannot discriminate in the terms or conditions of employment: based on a protected class, race, color, religion, gender, national origin. Different than race, applying only to skin tone.
