REC 440 Lecture Notes - Lecture 5: Sovereign Immunity
Document Summary
Immunity- a major category of defense for individuals and service providers from liability: immunity is normally a big category for recreation and sport management specifically, types of immunity: Sovereign immunity- an immunity of the state and its agencies, departments, board, institutions, etc. Governmental immunity- the protection of local governing entities: sovereign immunity and governmental immunity are interchangeable. This immunity came around so people wouldn"t sue states and make them so poor that they were no longer a state. The whole point of sovereign immunity and governmental immunity is so public agencies can be sued only if they give their consent. Sovereign/governmental immunity do not protect people who are wanton and willful or have reckless. Ex: uncw can be protected by sovereign immunity because it is a public college: 2. Does not extend to the officers, agents, or employees of the governing entity. In other words governmental immunity does not protect employees who work for the government from lawsuits.
